The quest for responsiveness: the regulatory design of the coexistence tests of telecommunications services in Brazil

[Purpose] In 2014 and 2019, Anatel, together with several actors, promoted coexistence tests between telecommunications services for the introduction of 4G and 5G mobile communication technologies in radio frequencies already used by other applications. In this article, these cases are described and analyzed using the responsive regulation theory.
[Methodology/approach/design] For the analysis, the case study method was adopted.
[Findings] Several characteristics of responsive regulation could be perceived, such as tripartite interaction, nodal governance, and responsiveness to industry’s structure.
[Practical implications] These characteristics opened possibilities for regulatory innovations and can be adapted to other situations in telecommunications and in other sectors.
[Originality/value] The study demonstrates opportunities for the responsive regulation theory beyond the pursuit of compliance, the most common application of the theory. Besides, the article indicates an intertwining between regulatory policy and technological development policy, highlighting the importance of non-regulated actors with in-depth technical knowledge, usually neglected in institutional analyses.
